Scope of application
These terms apply to every offer and agreement between ALHAN Groep B.V. and the client. We expressly reject the client’s purchasing conditions unless we have accepted them in writing beforehand.
Terms and conditions
These terms apply to all quotations, orders and agreements of ALHAN Groep B.V.: the supply of workers and the contracting of work. Deviations apply only where we have confirmed them in writing.

These terms apply to every offer and agreement between ALHAN Groep B.V. and the client. We expressly reject the client’s purchasing conditions unless we have accepted them in writing beforehand.

Quotations are valid for thirty days and without obligation unless stated otherwise. An agreement is formed by written order confirmation or by our starting the work with the client’s consent. Obvious calculation or typing errors are not binding on us.

The following applies to temporary agency work, secondment and self-employed contractor placement.

For fixed-price work, the description in the order confirmation constitutes the full scope. Additional work is carried out only after written instruction and at the agreed rates. Unforeseen ground conditions, cables and pipes that were not indicated, and delays caused by third parties are not at ALHAN’s risk.

Rates are exclusive of VAT and apply per hour worked or per agreed unit.

Where labour is made available, the client may pay the payroll-tax component into our blocked (G) account. We are NEN 4400-1 certified and listed in the register of the Dutch Labour Standards Foundation (SNA); on request we provide a quarterly tax authority payment-conduct statement.

Our people work in accordance with VCA and the client’s safety rules. For work on or alongside the railway, the infrastructure manager’s requirements apply in addition. If we identify an unsafe situation we may stop the work without incurring liability for damages.

If the client directly employs a worker supplied by us within six months of the end of the placement, a transfer fee is payable. The amount is stated in the order confirmation.

Our liability is limited to the amount our insurer pays out in the case concerned. If the insurer does not pay out, liability is limited to the invoice value of the assignment over the last three months. We are not liable for consequential loss, lost profit or standstill costs.

In the event of force majeure both parties may suspend the agreement. If the force majeure lasts longer than sixty days, either party may terminate the agreement in writing without liability for damages. Termination of an ongoing placement is subject to the agreed notice period.

Complaints about the work must be reported in writing within eight days so that we can put things right. A complaint does not suspend the payment obligation.

Dutch law applies to all agreements. Disputes are submitted to the competent court in the district of Rotterdam.
